General Terms and Conditions of Sale - Smart Solarium

1. Object and Scope of Application These general terms and conditions of sale govern all sales of Smart Solarium equipment, both nationally and internationally, made by Smart Technologies srl. These conditions apply to all purchases made by customers through our website or through direct agreements, unless otherwise agreed in writing between the parties.

2. Prices and Payment Terms The indicated prices are net of VAT and do not include delivery or installation costs, unless otherwise specified. Payment will be made according to the methods specified in the proforma or sales contract. A fixed cost of 200 euros + VAT will be applied for packaging the equipment for transport, regardless of whether our courier or the customer's own is used. The customer may request wooden crates for shipping at a cost of 450 euros + VAT, regardless of the chosen courier. Machines will be shipped disassembled for vertical models, while horizontal beds and facials will be delivered already assembled.

3. Initial Deposit as Confirmatory Down Payment The initial deposit requested is considered a confirmatory down payment and not an installment of the total price. The customer agrees that such deposit will be retained by Smart Technologies srl if they unilaterally decide to cancel the contract. In case of failure to collect the equipment within one year from the availability date, Smart Technologies srl will have the right to retain the deposit.

4. Delivery and Shipping Product delivery will take place according to the terms and methods agreed in the proforma or sales contract. Machines are designed to operate at 380 Volts, three-phase, and are equipped with a 32 Ampere five-pole plug. Delivery times are indicative and not binding. Any delays do not constitute grounds for withdrawal or request for compensation by the customer. Shipping can be arranged as EXW, CIF, or DAP, depending on the customer's requests.

5. Acceptance of Sales Terms Payment of the deposit or the full amount constitutes implicit acceptance of the general terms and conditions of sale published on our website. The customer confirms having read, understood, and fully accepted these conditions.

6. Warranty and Liability Smart Solarium equipment is covered by warranty as indicated in the documents provided at the time of sale. The warranty covers manufacturing defects and material faults for a period of 12 months from the date of delivery. The warranty does not cover damages caused by improper use, unauthorized maintenance, or negligence by the customer. To maintain warranty validity, the customer must perform at least one mandatory maintenance per year and use only original spare parts.

7. Installation and Training Installation and training are additional services, quoted separately based on the installation location. In general, basic training is included and provided by our technicians during installation.

8. Maintenance and Technical Assistance Maintenance is chargeable. To receive assistance, the customer must fill out a support ticket on our website. Spare parts must be original and branded Smart Solarium to ensure the validity of the warranty.

10. Returns and Refunds No returns or refunds are allowed under any circumstances.

11. Limitation of Liability Smart Technologies srl will not be liable for any direct, indirect, or consequential damages arising from the use of the equipment sold, including but not limited to economic losses, business interruption, and reputational damage.

12. Governing Law and Jurisdiction These terms of sale are governed by Italian law. For any disputes relating to these terms of sale, the competent court is the Court of Genoa, Italy.

13. Amendments to the Terms Smart Technologies srl reserves the right to modify the general terms and conditions of sale at any time. The new conditions will be effective from the date of publication on the website and will be deemed accepted by the customer unless otherwise communicated in writing.

Breezer

The breezer does not spray water:

  • Water tank: Make sure the tank is full and correctly inserted into its housing. Check that the cap is tightly closed.
  • Supply hose: Check that the hose connecting the tank to the breezer is not bent, crushed, or obstructed by debris. If necessary, remove any obstructions or replace the hose.
  • Breezer purge: Sometimes it may be necessary to bleed the system to eliminate any air bubbles. Refer to the user manual for specific instructions on how to bleed your model's breezer.
  • Nozzle: Check that the nozzle from which the water comes out is not obstructed. You can try to clean it gently with a pin or a toothpick.

The breezer is leaking water:
